Sen. Tim Kaine (D-Va.) recently revealed that the presence of narcotics is not a prerequisite for military strikes under Operation Southern Spear. Despite the administration's public insistence that the operations target drug traffickers, the military's own targeting criteria remain broad and unverified. This lack of transparency has drawn comparisons to historical "false positive" scandals, where military forces killed civilians to inflate success statistics.

Legal experts and human rights advocates, including Aaron Rechlin-Melnick of the American Immigration Council, emphasize that many victims are never tried, and some likely die by drowning after the strikes. While the administration maintains that the Caribbean and Pacific serve as legitimate battlegrounds, critics point to reports of fishermen being among the casualties and warn that the operation could expose officials to criminal liability under international law.
