The lawsuit, filed by the Rosen Law Firm, claims Hims & Hers failed to disclose that it shared sensitive consumer health information with third-party advertising platforms. Furthermore, the complaint alleges the company misrepresented its consultation process, charging customers for prescriptions immediately after they submitted intake forms rather than waiting for a medical provider to determine the appropriate treatment. These practices allegedly invited regulatory scrutiny and potential financial penalties, casting doubt on the company's prior positive statements regarding its business operations.

Investors seeking to participate in the class action are not required to pay out-of-pocket fees, as the litigation operates on a contingency basis. While the court has not yet certified a class, affected shareholders may choose to retain their own counsel or participate as absent members. Those interested in serving as lead plaintiff must submit a motion to the court by the November 2 deadline to help direct the litigation process.
