The company also questioned the validity of the certification on the grounds that the board lacked a quorum at the time of the regional director's decision.

A spokesperson for Whole Foods maintained the company's position, citing alleged illegal conduct by the union and restrictions on communication that prevented a fair vote. This defeat marks another chapter in a broader legal tug-of-war between Amazon and labor organizers, mirroring ongoing litigation over a 2022 unionization effort at a Staten Island facility currently pending before a federal appeals court.
